General Terms and Conditions

The general terms and conditions of Berlin Concept Catering, represented by David-Alexandre Barrois.  

Scope of application

The following terms and conditions apply to the entire business relationship of Berlin Concept Catering, i.e. all services for events and gastronomic catering (food truck catering & classic catering) as well as other related deliveries and services. Any deviating or supplementary agreements must be made in writing.

Offer and prices

The prices quoted are net prices and do not include the currently applicable statutory VAT.

Placing an order 

All offers made by Berlin Concept Catering are subject to change. Every order must be confirmed in writing by the customer and is only then binding for both parties.

If the customer is the agent or event planner of a third party ("client"), both shall be jointly and severally liable for the fulfillment of the obligations arising from the contract. By signing Berlin Concept Catering's offer, the agent/organizer declares that he is authorized to do so by his client. The contractual partner and customer of Berlin Concept Catering and thus the invoice recipient is initially the agent/organizer.

Changes

Berlin Concept Catering reserves the right to replace parts of the buffet and food on offer with equivalent dishes due to seasonal and quality-related fluctuations and for reasons for which Berlin Concept Catering is not responsible. Berlin Concept Catering will endeavor to inform the customer in good time and ensure that the substitute product comes as close as possible to the character of the original product to a reasonable extent.

Terms of payment

The catering offer made is deemed to be a contract between Berlin Concept Catering and the customer as soon as the customer has signed it. 

Once the contract has been signed, a down payment invoice will be issued for 50% of the expected total invoice amount. This deposit must be paid within 15 days of signing the contract.

Berlin Concept Catering will issue the final invoice after the event.

Cancellation policy

  • Cancellations up to 10 weeks before the event will incur a cancellation fee of 20% of the agreed fee.

  • Cancellations up to 6 weeks before the event will incur a cancellation fee of 50% of the agreed fee.

  • Cancellations up to 2 weeks before the event will incur a cancellation fee of 80% of the agreed fee.

  • Cancellations made less than 2 weeks before the event will incur a cancellation fee of 100% of the agreed fee.

Liability

The customer is responsible for the proper care of the equipment provided and is liable for any loss or damage caused by participants at the event.

Berlin Concept Catering accepts no liability for personal injury and/or damage to property occurring before, during or after the event, unless such damage is due to gross negligence or intent on the part of the company.

Final provisions

The agreements between Berlin Concept Catering and the organizer are subject to German law, even if they have points of contact with foreign countries.

Written notifications of contract amendments, declarations of withdrawal, terminations, reminders or notices of defects on the part of the organizer must be addressed to Berlin Concept Catering.

Should individual clauses of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

Berlin shall be the place of jurisdiction for all disputes.
