General Terms and Conditions
The general terms and conditions of Berlin Concept Catering, represented by David-Alexandre Barrois.
Scope
The following terms and conditions apply to all business relationships of Berlin Concept Catering, i.e. all services for events and gastronomic services (Food Truck Catering & Classic Catering) as well as other related deliveries and services. Deviating or supplementary agreements must be made in writing.
Offer and prices
The prices quoted are net prices and do not include the applicable statutory value-added tax.
Placing an order
All offers from Berlin Concept Catering are subject to change. Each order must be confirmed by the customer in writing and is only binding for both parties once this has occurred.
If the customer is an intermediary or event planner of a third party (“Client”), both are jointly and severally liable for the fulfillment of the obligations arising from the contract. By signing the offer from Berlin Concept Catering, the intermediary/organizer declares that they are authorized to do so by their client. The contractual partner and customer of Berlin Concept Catering, and thus the invoice recipient, is initially the intermediary/organizer.
Changes
Berlin Concept Catering reserves the right to replace parts of the buffet and food selection with equivalent food items due to seasonal and quality-related fluctuations, as well as for reasons for which Berlin Concept Catering is not responsible. Berlin Concept Catering will endeavor to inform the customer in good time and ensure that the substitute product comes as close as possible to the character of the original product to a reasonable extent.
Terms of payment
The created catering offer is considered a contract between Berlin Concept Catering and the customer as soon as the customer has signed it.
After conclusion of the contract, a down payment invoice will be issued, which amounts to 50% of the expected total invoice amount. This deposit is payable within 15 days of signing the contract.
Berlin Concept Catering will issue the final invoice after the event.
Cancellation Policy
If you cancel up to 10 weeks before the event, you will be charged a cancellation fee of 20% of the agreed price.
If you cancel up to 6 weeks before the event, you will be charged a cancellation fee of 50% of the agreed price.
If you cancel up to 2 weeks before the event, you will be charged a cancellation fee of 80% of the agreed price.
If you cancel less than 2 weeks before the event, you will be charged a cancellation fee of 100% of the agreed price.
Liability
The customer is responsible for the proper care of the equipment provided and is liable for any loss or damage caused by participants of the event.
Berlin Concept Catering is not liable for any personal injury or property damage that occurs before, during, or after the event, unless such damage is due to gross negligence or willful misconduct on the part of the company.
Final Provisions
The agreements between Berlin Concept Catering and the event organizer are subject to German law, even if they have international connections.
Written notifications regarding contract changes, withdrawal declarations, terminations, reminders, or notices of defects from the event organizer must be sent to Berlin Concept Catering.
Should individual clauses of these General Terms and Conditions be ineffective, the validity of the remaining provisions shall remain unaffected.
Berlin is the place of jurisdiction for all disputes.
